Terms and Conditions

(For the purposes of these Terms, the following terms—“Affiliate Program,” “Creative Partnership Program,” and “Creator Program”—are used interchangeably.)

1. Introduction

Welcome to the Polygloti Creative Partnership Program (“Program”). By joining this Program, you agree to:

  1. Abide by these Terms and Conditions (“Terms”) outlined below.
  2. Accept our general Polygloti Terms and Conditions.
  3. Confirm that you have read and agree to our Privacy Policy.

You should review all documents carefully prior to participating in the Program.

Full and Irrevocable Rights to Use Partner-Created Content

By participating in this Program, you grant Polygloti a full, non-exclusive, irrevocable, worldwide, royalty-free license to use, reproduce, edit, adapt, overdub, distribute, publicly display, and create derivative works from any content you create as part of this Program, without any additional compensation. This includes the right to use such content in Polygloti’s marketing and advertising materials.

2. Definitions

  • “Polygloti,” “we,” “us,” or “our” refers to Polygloti, a brand operated by LAB 106, MB or its successors and assigns.
  • “You,” “your,” “Partner,” or “Affiliate” refers to the individual or entity participating in this Program.
  • “User” or “Customer” refers to any person who visits Polygloti’s website or purchases Polygloti’s products or memberships after being referred by you using your unique affiliate link.
  • “Content” refers to any promotional material, text, images, videos, or other works created by you in relation to this Program.

For clarity, references to “Affiliate Program,” “Creative Partnership Program,” and “Creator Program” mean the same Program described in these Terms.

3. Eligibility

To participate in the Polygloti Creative Partnership Program, you must:

  1. Be at least 18 years of age.
  2. Provide accurate and complete information when applying for the Program.
  3. Ensure you have read and agree to be bound by these Terms, our General Terms and Conditions, and our Privacy Policy.

Polygloti reserves the right to approve or reject any Creative Partnership Program application at its sole discretion. You will have no legal recourse against us for the rejection of your application.

4. Modifications to Terms of Service

Polygloti may update or modify these Terms at any time, with or without prior notice. By continuing to participate in the Program after any modifications are posted, you agree to the revised Terms. If any modification is unacceptable to you, your only option is to terminate your participation in the Program in accordance with Section 10 (Termination).

In addition, Polygloti reserves the right to unilaterally change any terms of this Agreement, including commission rates applicable to existing memberships for future periods, without additional compensation or liability to you. This may include changes to payment terms, commission structures, or other Program details.

5. Account Creation & Maintenance

  1. Accurate Information
    You must provide your full legal name, a valid email address, and any other information requested by Polygloti before receiving commission payments. You are responsible for ensuring this information remains accurate and up to date.
  2. One Account per Person or Entity
    You may not maintain more than one account. If multiple accounts are detected, Polygloti may, at its discretion, terminate or suspend any or all accounts associated with you.
  3. No Automated Methods
    Registration via “bots” or other automated methods is not permitted.
  4. Responsibility for Activities
    You are responsible for all activities that occur under your account, including those by any individuals who gain access through your account credentials.
  5. Prohibited Uses
    • You may not use the Program for any unauthorized or illegal purposes or in violation of any local, state, or federal laws.
    • Unauthorized use of Polygloti’s intellectual property or branding (logos, trademarks, etc.) is strictly prohibited unless specifically allowed under these Terms.

 

6. Content Best Practices

You agree to promote Polygloti through various channels (websites, social media, email, etc.) in a legal and appropriate manner. You must adhere to the following guidelines:

  1. No Infringing Use of Trademarks
    You may not bid on branded keywords (e.g., “Polygloti discount,” “Polygloti coupon”) or otherwise use Polygloti’s trademarks in paid advertising without prior written consent.
  2. No Harmful Content
    You may not publish or distribute any content that is abusive, discriminatory, illegal, deceptive, or could harm Polygloti’s reputation.
  3. Compliance with Intellectual Property Rules
    Polygloti grants you a limited, revocable, non-exclusive license to use its name, logos, and brand identifiers in the creation and distribution of promotional materials, solely for lawful promotion of Polygloti. You must not violate the intellectual property rights of Polygloti or any third party.
  4. Editing and Marketing Use
    By agreeing to these Terms, you grant Polygloti the right to edit, remix, or otherwise adapt any content you create for marketing and advertising purposes without further approval or compensation.

 

7. Payment & Commissions

7.1 General Commission Structure

  • Polygloti often offers individualized commission rates, determined during the application process.
  • Many affiliates earn 30% commissions for the first 12 months of each paid plan referred, although different terms may apply based on your specific arrangement with Polygloti.

 

7.2 Commission Examples

Below are some example scenarios that illustrate potential earnings, based on popular Polygloti plans. These are for illustration only and may not reflect your exact commission rate:

  • 3-Month Plan (e.g., $29.99 initial, $38.99 renewal):
    • 10 users choosing the 3-Month Plan could result in $440.88 in commissions on $1,469.60 in total sales.
    • 30 users choosing the 3-Month Plan could result in $1,322.64 on $4,408.80 in total sales.

 

7.3 Commission Eligibility & Tracking

  • Active Subscription Requirement: Commissions are typically released once a referred User’s subscription has been active for at least 21 days (or 30 days, depending on your specific arrangement).
  • Cookie Duration: The cookie duration is 30 days. You will earn a commission if a user makes a purchase within 30 days of clicking your referral link.

 

7.4 Payment Logistics

  • Payment Schedule: Payments are processed monthly, typically between the 1st and 15th day of the month, covering commissions for subscriptions that have met the required waiting period in the previous month.
  • Minimum Payout Threshold: The minimum payout threshold is $50. If your account balance is below $50 in any payment cycle, the balance will carry over to the next cycle.
  • Payment Methods: Payments are generally issued via PayPal or another payment processor as determined by Polygloti.
  • Delays & Disputes:
    • Polygloti reserves the right to extend the waiting/activation period (e.g., for PayPal’s dispute period of up to 180 days).
    • If there are questions of fraud or other risks, Polygloti reserves the right to limit or withhold payouts until issues are resolved.

 

7.5 Refunds and Chargebacks

If a referred user requests a refund or issues a chargeback, the commission associated with that transaction will be deducted from your future payouts. Commissions are only valid if the referred customer remains active without refund requests.

7.6 Exclusive Payment Terms

Polygloti reserves the right to apply exclusive payment terms to certain partners or under special circumstances, at its sole discretion.

8. Referral Tracking

  1. Affiliate Links
    You will receive a unique referral link. To ensure proper tracking and commission accrual, you must use your affiliate link in the format provided. If a transaction is completed without your affiliate link, you may not be credited for the referral.
  2. Coupon and Deal Sites
    • You may not advertise unauthorized or misleading coupons or deals.
    • You may not generate pop-ups or other actions that forcibly set affiliate cookies without the user’s explicit consent.
    • You must not imply coupons exist if none are valid for your specific affiliate arrangement.
  3. Pay Per Click (PPC)
    PPC bidding is not allowed without prior written permission from Polygloti.

 

9. Compliance & Laws

You agree to comply with all applicable laws, rules, and regulations within your jurisdiction and the jurisdiction of Polygloti. This includes (but is not limited to) advertising standards, consumer protection laws, and data protection regulations.

10. Termination

Polygloti may unilaterally terminate your account and participation in the Program at any time, with or without cause, and without additional compensation. Reasons for termination include, but are not limited to:

  • Violation of these Terms or any guidelines referenced herein.
  • Misleading advertising, spamming, or other fraudulent activities.
  • Promotion of illegal or harmful content or activities.
  • Self-referrals or suspicious transactions.
  • Impersonation of Polygloti or creation of sites/profiles that mislead visitors to believe they are official Polygloti pages.

Upon termination, Polygloti may also withhold any outstanding commissions if it determines these commissions were earned through improper or prohibited methods. Polygloti has the right to end or pause the entire Program at its sole discretion, which would terminate all future commission payments.

Furthermore, termination does not entitle you to any compensation for the cessation of potential or “test” memberships that might have been referred.

11. Relationship

Your participation in this Program does not create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between you and Polygloti. You are considered an independent contractor for all purposes.

12. Limitations & Disclaimers

  1. No Warranty
    Polygloti does not guarantee uninterrupted or error-free operation of the Program. We are not responsible for any indirect or accidental damages, including loss of revenue or commissions.
  2. Liability
    Polygloti will not be liable for damages arising out of your participation in the Program or any claims relating to these Terms. Your sole remedy is to terminate your account and participation in the Program.
  3. Indemnification
    You shall indemnify and hold harmless Polygloti and its subsidiaries, directors, employees, and agents from any claims, damages, liabilities, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your negligence, fraud, or willful misconduct in carrying out your obligations under this Program.

 

13. Acknowledgment

By participating in the Polygloti Creative Partnership Program, you acknowledge and represent that you have read, understood, and agree to be bound by these Terms and all other documents incorporated by reference, including the Polygloti Terms and Conditions and the Privacy Policy.

These Terms constitute the entire agreement between Polygloti and you concerning the Program and supersede all prior or contemporaneous agreements and understandings.
